1. Agreement to Our Legal Terms
These Terms and Conditions (“Terms”) govern all sales of the $97 Growth Starter Package (the “Service”) offered by Advice and Innovation Ltd (“Company,” “we,” “us,” or “our”) to the Buyer ("you")

By purchasing the Service you agree to be bound by these Terms.
If you do not agree, do not purchase or use the Service.
The Terms are governed by the laws of England and Wales.
The Service is intended primarily for business customers (B2B).
However, where an individual (“consumer”) purchases for non-business use, sections 14–15 of these Terms describe their rights under UK law.
2. Description of the Service
The Service consists of a one-off marketing package comprising:
A batch of four (4) single-image Facebook ad creatives;
One email-marketing design; and
A one-on-one call (via Google Meet, approximately 30 minutes, duration at our discretion) that includes a Facebook Ad Account setup.
No ad copywriting, targeting, or media-buying is included.
Creatives are custom-made using our templates and tools.
No revisions are included.
Completion occurs once the creatives, email design, and call have been delivered.
Average turnaround ≈ 7 days (min 2 / max 14) depending on the booked call date.
All Services are delivered remotely.
3. Onboarding and Client Responsibilities
After payment you will be redirected to an onboarding process:
You must complete a Typeform providing accurate company, product, and branding information; and
You must book your onboarding call via the provided Calendly link.
We will contact you once if either step is missing.
If, after that contact, you fail to supply the necessary information or schedule the call within 14 days, we will be unable to complete the Service.
In that case, the Service will be considered voided, and you will receive a 50 % refund, acknowledging partial work and follow-up already performed.
All work is based solely on the information you submit in the Typeform.
You are responsible for ensuring that information is accurate and complete.
4. Commencement and Delivery
Work begins immediately after payment is confirmed. By purchasing, you acknowledge that the Service may start immidiately after payment.
Delivery is by email with access to a Google Drive folder containing final creative exports.
The one-on-one call is conducted via Google Meet and may be recorded with your explicit consent for internal training purposes; you may request a copy.
5. Fees and Payment
The price of the Service is $97 USD, payable in full upfront via Stripe.
No VAT is charged.
Invoices will be issued within 14 days after payment.
All payments are final and non-transferable.
Unauthorised chargebacks constitute breach of contract and immediately void the Service; we reserve the right to recover the payment, legal costs, and related fees.
6. Refund and Cancellation Policy
Business Customers (B2B)
Because work begins immediately, no cancellations or refunds are permitted.
Consumers (B2C)
Consumers have statutory rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
If you are purchasing as a consumer (for personal use and not in the course of business), you may request a full refund at any time before the Service has been fully completed.
Once the Service has been completed (defined as delivery of all creatives, email design, and the one-on-one call), the contract is considered fully performed and no refund will be available.
All refund requests must be submitted in writing to mark@adviceandinnovation.com.
7. Intellectual Property and Usage Rights
All materials, methods, and templates used to create the Service remain our intellectual property.
Upon full payment, you receive a non-exclusive licence to use the delivered creatives, email design, and ad account setup for your own business purposes only.
You may not resell, sublicense, or distribute any part of the materials to third parties.
We retain the right to display the work, anonymised results, or testimonials in our portfolio and marketing materials.
Editable source files may be provided separately at our discretion and under a separate agreement.
8. Client Conduct and Non-Solicitation
You agree not to:
Hire or solicit any employee, contractor, or supplier of Advice and Innovation Ltd for 12 months after completion;
Copy, reproduce, or offer a competing service based on our methods or materials.
9. Confidentiality and Data Protection
We will keep all client materials and information confidential and use them solely to deliver the Service.
Personal data will be processed in accordance with the UK GDPR and the Data Protection Act 2018.
Please review our Privacy Policy for details on how we collect and process personal data.
10. Limitation of Liability
Our total liability arising out of or in connection with the Service, whether in contract, tort, or otherwise, shall not exceed USD $97 (the amount paid).
We are not liable for indirect, consequential, or loss-of-profit damages.
No guarantee of advertising or financial results is given.
If you breach the IP or resale restrictions, your liability for resulting damages shall be limited to USD $10,000 or the actual damages incurred, whichever is lower.
11. Dispute Resolution
Both parties will first attempt to resolve disputes amicably through good-faith negotiation (including potential refund or replacement).
If no resolution is reached, disputes shall fall under the exclusive jurisdiction of the courts of England and Wales.
12. Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, governmental actions, cyber-attacks, or platform outages.
13. Termination
We may terminate or suspend the Service immediately if:
You fail to provide required information within 14 days;
You engage in chargebacks, abuse, or unlawful activity; or
You breach any of these Terms.
We reserve the right, at our sole discretion, to decline, cancel, or refuse to perform the Service at any stage prior to completion. In such cases, we will issue a full refund of all amounts paid, and no further obligations shall exist between the parties.
Upon termination, access to all Service materials ceases immediately.
14. Consumer Rights Notice
Nothing in these Terms limits or excludes any statutory rights afforded to consumers under the Consumer Rights Act 2015 or related UK legislation.
However, the Service is primarily intended for business use, and by purchasing you confirm that you are acting for business purposes unless otherwise indicated. If a consumer purchases for personal use, refunds are available up until completion as described in Section 6.
15. Amendments and Entire Agreement
We may update these Terms at any time by posting a new version on our website.
The current version in effect at the time of purchase governs your order.
These Terms constitute the entire agreement between you and Advice and Innovation Ltd for the Service.
